Dogging the Witness

by Nick Morgan

As if it were hard enough to make practicing law fun, the system is making it harder:

A Manhattan judge has fined an attorney $8,500 for barking like a dog at a witness and other bad behavior, according to a decision published in the New York Law Journal Thursday.

Other bad behavior? Involving a fire hydrant? I wouldn't give the guy a scooby snack, but $8500 bucks is pretty harsh.

I've got to disagree with you here, Nick. That lawyer (appropriately named "Fink") wasn't trying to make practicing law fun, he was being an ass, wasting the other side's time and money, and wasting the court's time.

That's what the contempt power is for. I wouldn't doubt if the penalty wasn't tied to the amount of money in fees that the other side had to spend responding to Fink's loutish behavior.

Was the judge's bite worse than the lawyer's bark? In the old days, the judge would have given Fink a can of Thrivo. Cruel and unusual punishment?

Greg, that's a reasonable point, but I was hoping my post would come across tongue-in-cheek. I guess that's what happens when the unqualified attempt humor....
